A consumer may file a complaint with the District Forum o, State Commission or, the National Commission depending on the jurisdiction of these. Both pecuniary and territorial jurisdiction must be considered by consumer before filing a complaint. There is a concrete procedure that is to followed when a complaint is filed by the consumer. The procedure to settle complaint is governed under section 12, 13, 14, 18, and 22 of consumer protection Act. I. When complaint is filed with District Forum 1. Manner in which complaint is filed (Section 12) The manner in which complaint can be filed cover three precise questions namely: (i) Who can file a complaint? The Consumer Dispute Redressal Machinery is a THREE-TIER, Quasi-Judicial Machinery for speedy and inexpensive redressal of consumer grievances and disputes. The Consumer Dispute Redressal Machinery is an easy redressal alternative for the consumers than the ordinary process of the civil court which is a very expensive and time consuming litigation process. The Consumer Dispute Redressal Forum has been established at three levels: Central level, State level and District level. These quasi-judicial bodies are supposed to observe the principles of natural justice and are empowered to: (i) To give relief of a specific nature and (ii) To award, where ever appropriate compensation to consumers. I. DISTRICT FORUM 1. Consumer protection councils are the advisory bodies which have been established at three levels – central, state and district levels. These bodies have been set up for promoting and protecting the interests of the consumers. These councils have been entrusted the task of protecting the rights of the consumers. The Central consumer protection council: 1. Establishment (U/S 4 (1)): The central government shall establish central consumer protection council by notification with effect from such date as may be specified in such notification. 2. Composition (U/S 4 (2)): The Central council shall consist of the following members, viz: (a) The minister in charge of consumer affairs who shall be its chairman. (b) Such number of other official or non-official members representing such interests as may be prescribed. 3. Consumer (Sec 2(1)(d)): Consumer may be a person: a) Who buys or agrees to buy goods for consideration for personal use. b) Who uses such goods with permission of buyer of goods. c) Who obtains goods on hire purchase or lease. d) Who hires or avails of any services for a consideration. e) Who uses the services with permission of person who has hired the services. f) Who obtains services on deferred payment basis i.e. hire purchase or lease. g) Who buys goods or hires services exclusively for purpose of earning his livelihood as self – employment. 2.
