PREVENTION, CONTROL AND ABETMENT OF ENVIRONMENTAL POLLUTION
1. Persons carrying on industry, operation, etc., not to allow emission or discharge of environmental pollutants in excess of the standards (Sec 7): No person carrying on any industry, operation or process shall discharge or emit or permit to be discharged or emitted any environmental pollutant in excess or such standards as may be prescribed.2. Persons handling hazardous substances to comply with procedural safeguards (Sec 8): No person shall handle or cause to be handled any hazardous substance except in accordance with such procedure and after complying with such safeguards as may be prescribed.
3. Furnishing of information to authorities and agencies in certain cases (Sec 9): If discharge of any environmental pollutant is in excess of the prescribed standards, then the person responsible for such discharge or the person in charge of such place:
a. Shall be bound to prevent or mitigate the environmental pollution caused as a result of such discharge.
b. Shall intimate the fact of occurrence.
c. Shall be bound to render all assistance
U/S 9(2), the authorities concerned shall on intimation, take remedial measures to prevent or mitigate the environmental pollution.
U/S 9(3), the expenses if any incurred by such authority with respect to the remedial measures together with interest from the date when a demand for the expenses is made until it is paid, may be recovered by such authority or agency from the person concerned as areas of land revenue or of public demand.
4. Power of entry and inspection (Sec 10): Any person empowered by the Central Government in this behalf shall have a right to enter, at all reasonable times with such assistance as he considers necessary, any place:
a) For the purpose of performing any of the function of the Central Government entrusted to him;
b) For the purpose of determining whether any provision, rules any notice, other, direction served under this Act has been complied with;
c) For the purpose of examining and testing any equipment, industrial plant, record, register, document or any other material object.
5. Powers to take sample (Sec 11): The Central Government or any officer empowered by it, shall have power to take, for the purpose of analysis, samples of air, water, soil or other substance from any factory, premises or other place in such manner as may be prescribed.
6. Power to establish environmental laboratories (Sec 12): The Central Government is empowered to:
a) establish one or more environmental laboratories;
b) recognise one or more laboratories or institutes as environmental laboratories and
c) make rules for functioning of such laboratory
7. Power to appoint Government Analyst (Sec 13): The central Government may appoint or recognise such person to be Government Analyst for the purpose of analysis of samples of air, water, soil or other substance sent for analysis to any environmental laboratory established.
8. Reports of Government Analysts (Sec 14): Any document purporting to be a report signed by a Government Analyst may be used as evidence of the facts stated therein in any proceeding under this Act.
